Labor safety Committees have been established in structural divisions of OAO TATNEFT from representatives of the employer and Trade Union on a parity basis according to the rights of the Trade Union to implement labor safety control at the enterprise defined by the Labor Code of the Russian Federation and other acts.
116 persons of each party, representatives of the Trade Union and the administration, have been elected into the structure of labor safety committees of various levels.
The Committees develop a program of joint actions of the administration and the Trade Union Committee on improvement of the labor safety conditions and prevention of an industrial traumatism and occupational diseases. Members of the committees participate in preparation of the «Labor Safety» section, the Collective Agreement and the Labor Safety Agreement; they inform workers on the conditions and the state of labor protection at the workplaces, as well as about existing risks of damage to health and protection means given to workers and compensations and benefits paid to them. There is a developed and approved «Provision on the Labor Protection Committee (Commission) in OAO TATNEFT» functional in the Company which defines problems, functions, rights and guarantees of the rights of the Committee members.
The Collective Agreements of OAO TATNEFT provide for the responsibility of the employer to organize work of the Labor Safety Commissions at all enterprises of the Company: to finance the Commissions operation, to allocate premises for their operation, to provide them with communication facilities and office equipment, to provide with the necessary normative and technical documentation, to arrange training of the Commissions' members at the expense of the enterprises or at the expense of the Social Insurance Fund of the Russian Federation.
The Trade Union Committee realizes the rights through the Labor Safety Committees established by the primary organizations, structural and affiliated companies. The reports of the economic heads, chairmen of the Trade Union Committees, experts of structural divisions and the affiliated companies allowing the growth of industrial traumatism and fatal accidents, are presented at the Committees' sessions.
The information about the Committee's work is made available to the Trade Union members at annual meetings of the Joint Stock Company's labor safety standing committees as well as through the corporate newspaper «Neftyanye Vesti» («Oil News») and through the monthly newsletter of the OAO TATNEFT Trade Union Committee titled «Tribune».
Protection of the Trade Union members' rights with regard to safety of work is implemented through authorized representatives. The institution of the labor safety authorized persons totals 1774 ones as of today. 17498 proposals have been submitted for the Administration's consideration.
«Methodical recommendations for realization of the labor safety public control» have been developed for assisting the authorized representatives in performance of their everyday duties and Provision has been adopted regarding the authorized (entrusted) persons of the OAO TATNEFT Trade Union for labor safety as well as distinctive breast badges «Representative of the OAO TATNEFT Trade Union for labor safety» have been instituted. All representatives have been provided with Methodical recommendations and badges.
The following is stated in the Collective Agreement of TATNEFT Open Joint Stock Company:
«The employer undertakes to render assistance in the work of the Trade Union safety representatives, to organize their training at the expense of enterprises (or at the expense of the Social Insurance Fund of the Russian Federation), to release them from duties for the period of training with retention of monthly average earnings.
For the purpose of realizing the functions of the control and supervision the representatives are allowed two working hours a week with earnings retention. There should be provided the guarantee of their activity in accordance with the federal law «About Trade Unions, their rights and activity guarantees» No.10-FZ dated January 12, 1996».
A Competition for the title «Best Trade Union representative for labor safety of the enterprise» is arranged on a regular basis» at the Company's enterprises. The best authorized representatives are encouraged with cash bonuses for active work on labor safety based on the results of the year.
